Commonwealth Court Upholds Limits on Number of Pets
Commonwealth Court ruled on May 27, 2008, that a Monoghan Township ordinance, which limited the number of domestic pets per household, was valid. The Wolls owned 14 dogs on 2.5 acres in a rural neighborhood. The township cited them several times for violating the ordinance, which allowed six pets.
The Wolls argued to the zoning hearing board and York County Court of Common Please that the ordinance was vague in defining "pet." The Judge ruled that the township had statutory authority to limit the number for health and safety reasons.
